On February 25, 2021, the Washington State Supreme Court declared the current Possession of a Controlled Substance law unconstitutional.

If you have been convicted of the crime of Possession of a Controlled Substance, you may be entitled to have this removed from your record. That removal could include:

  • An adjustment to a sentence for another crime being currently served based on a revised offender score
  • A refund of fines, fees, and court costs paid for the conviction
  • The removal of a felony from your criminal history
  • A challenge to any criminal charge predicated upon the initial conviction, such as Unlawful Possession of a Firearm.
