Non-conforming structures
Legal Non-conforming structures are allowed to remain, subject to the nonconforming provisions of the SMP (MCC 17.50.120 - Existing structures, uses and lots.).
The re-alignment a legal nonconforming structure is also allowed, subject to all applicable SMP provisions. For example, a legal, nonconforming 500 square-foot boat house can be removed, resulting in 500 square feet of additional footprint for a sunroom in the structure setback (see Figure 1 below, MCC 8.52.170(E)(4)(j)(iii)), so long as there is a demonstrated no-net-loss of shoreline ecological functions, as demonstrated by a qualified professional.

2. Common Line Setbacks
For building additions on legal nonconforming development, new development must not expand the nonconformity. For example, a building addition must meet existing common line setbacks.
